    Positive Copyright and Open Content Licences: How to Make a Marriage Work by Empowering Authors to Disseminate Their Creations

    Positive copyright appears to have been progressively turned away from its normative function of ensuring a fair and efficient transmission of human knowledge. The private sector is seeking to counterbalance this phenomenon by adopting legal tools that expand the public domain of knowledge, such as web-based licences modelled on the "open access" approach. The increasing world-wide preference for Creative Commons licences confirms their aptness to transform copyright law into a tool flexible enough to serve authors' several purposes. Such a spontaneous counterbalance experiences many difficulties though, because of the structure that positive copyright has adopted over the last few years. The current situation is an excellent point from which to look back at how authors used to disseminate their works before the advent of the Internet. From a historical view-point copyright has always accomplished the twin functions of economically rewarding authors and enabling communication of their creations to the public. The latter goal is achieved by means of statutory mechanisms limiting the freedom of contract between authors and their counterparts (intermediaries in a broad sense), in order to enforce the authors' capacity to spread their works. In the current digital environment, however, these mechanisms are not likely to accomplish their original functions. This paper seeks to explore an adjustment that will permit authors to take advantage of all the new means of commercial exploitation and non-commercial dissemination of their works offered by the Internet. Such an adjustment aims also at realigning positive and normative copyright by encompassing the use of open content licensing within the current copyright framework

    Sharedness as an innate basis for communication in the infant

    From a cognitive perspective, intentional communication may be viewed as an agent's activity overtly aimed at modifying a partner's mental states. According to standard Gricean definitions, this requires each party to be able to ascribe mental states to the other, i.e., to entertain a so-called theory of mind. According to the relevant experimental literature, however, such capability does not appear before the third or fourth birthday; it would follow that children under that age should not be viewed as communicating agents. In order to solve the resulting dilemma, we propose that certain specific components of an agent's cognitive architecture (namely, a peculiar version of sharedness and communicative intention), are necessary and sufficient to explain infant communication in a mentalist framework. We also argue that these components are innate in the human species

    The present paper consists of two main parts. The first one gives a picture of the more recent development of the farmland market in selected EC countries since 1985/86. Two main indicators are used to make relatively comparable the observed trends concerning: i) land mobility, ii) farmland values. The second one tries to evaluate the effects of the CAP reform and the influence of national variables overtime, taking into account the following indicators: i) mobility (on land transfers; on tenancy), ii) income (for agricultural or forest use), iii) farmland values (in the plain; in the hill/mountain areas). Considerations on land market complexity and segmentation are finally included, with justification on the empirical approach adopted in the paper.

    Many practical problems of quality control involve the use of ordinal scales. Questionnaires planned to collect judgments on qualitative or linguistic scales, whose levels are terms such as "good," "bad," "medium," etc., are extensively used both in evaluating service quality and in visual controls for manufacturing industry. In an ordinal environment, the concept of distance between two generic levels of the same scale is not defined. Therefore, a population (universe) of judgments cannot be described using "traditional" statistical distributions since they are based on the notion of distance. The concept of "distribution shape" cannot be defined as well. In this article, we introduce a new statistical entity, the so-called ordinal distribution, to describe a population of judgments expressed on an ordinal scale. We also discuss which of the traditional location and dispersion measures can be used in this context and we briefly analyze some of their properties. A new dispersion measure, the ordinal range, as an extension of the cardinal range to ordinal scales, is then proposed.
